Before the hearing

How to find the weak spots in your custody case before court

Build the case against yourself, before their lawyer does.

This is the most useful hour of preparation you will spend, and the one nobody wants to spend.

Sit down and build the case against yourself, as if you were the other parent's lawyer working from your own messages, statements and history.

Why it matters

Every weak point in your case exists whether or not you've looked at it. The only variable is whether you find it first, on your own terms, with time to think, or whether it's put to you for the first time in a hearing room.

The parents who come through questioning best aren't the ones with nothing against them. They're the ones who already knew exactly what was coming.

What you're looking for

  • Your own words, read cold. Not with the context and good intentions you know were behind them. Only what's on the page.
  • Anything that could be used against you, however unfair it feels. A message sent in anger. A decision that looks worse out of context.
  • Contradictions between your own documents. Two accounts of the same event, written months apart, described slightly differently.
  • Points that rest only on your explanation. An explanation given from the witness box is much weaker than a document. Where that's all you have, it's a real vulnerability.

This is not self-blame

It's preparation. The goal is that nothing lands as a surprise, and that you already have a calm, honest answer for each point.

It feels like helping the other side. It isn't. Far better to find these things at your kitchen table than for the first time in front of a judge.

Once you have the list, the next question is what to do with each item, and that depends on how serious it is, not on how it made you feel to find it.

General information, not legal advice. Court process differs between countries and regions; check anything that matters to your case with a qualified lawyer where you live.

In the workbook

Chapter 11 of the workbook takes you through building the case against yourself, step by step. Worksheet H, the self red-team checklist, gives every weak point a row: evidence or only explanation, severity, your planned honest answer, and whether it has gone to your lawyer.
